Constitutional Law
When a right the Constitution protects is taken away, the remedy lies in a writ petition.
When a law, a government order, or an act of a public authority takes away a right that the Constitution protects, the remedy lies in a writ petition before the High Court under Article 226 or before the Supreme Court under Article 32. We prepare and argue these petitions and act both for citizens whose rights have been affected and for authorities defending their action.
Our work in this field includes the enforcement of fundamental rights, challenges to legislation and to executive and administrative orders, public interest litigation on matters of public concern, preventive detention and habeas corpus petitions where a person is unlawfully detained, and the writs of mandamus to compel a public duty, certiorari and prohibition against orders passed without jurisdiction, and quo warranto against the holding of a public office. We also handle service and quota related constitutional questions, questions of legislative competence, and challenges founded on the basic rights to equality, life and liberty, and freedom of speech and movement.
We act for the petitioner seeking a remedy and, where instructed, for the respondent authority upholding its decision. These matters are carried through the High Court of Andhra Pradesh at Amaravati and, by appeal and by special leave under Article 136, to the Supreme Court of India, and constitutional questions of importance are taken directly to the Supreme Court under Article 32. Cases in this field turn on close reading of the record and the settled position of law, and that is how we prepare them, relying on rulings that hold the field and not on those since overruled.
